This website is operated by StyleColab Preloved. Throughout the site, the terms “we”, “us” and “our” refer to StyleColab Preloved.

By accessing our website, purchasing from us, consigning with us, renting a rack, using our in-store services, or otherwise engaging with StyleColab Preloved, you agree to be bound by these Terms of Service, together with any additional terms, conditions and policies referenced on our website or made available to you.

These Terms apply to all users of our website and services, including browsers, customers, consignors, rack renters, merchants and contributors of content.

If you do not agree to these Terms, you must not access or use our website, purchase from us, consign with us or use our services.

We reserve the right to update, change or replace any part of these Terms at any time. Continued use of our website or services after any changes are published constitutes acceptance of those changes.

Our online store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services.

1. Online Store Terms

By using this website, you confirm that you are at least the age of majority in your state or territory of residence, or that you have given consent for any minor dependants to use this site.

You must not use our products, website or services for any unlawful or unauthorised purpose.

You must not breach any applicable laws, including copyright laws, intellectual property laws, privacy laws or consumer protection laws.

You must not transmit viruses, malware, worms or any destructive code.

Any breach of these Terms may result in the immediate termination of your access to our website or services.

2. General Conditions

We reserve the right to refuse service to anyone at any time, where permitted by law.

You understand that your content, excluding payment information, may be transferred unencrypted and may involve transmission over various networks. Payment information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our website, products, services or in-store offering without our express written permission.

We may modify, suspend or discontinue any part of our website, services or in-store offering at any time.

3. In-Store Service Fees

A $3 per transaction in-store service fee may apply. This fee supports the personalised styling, curation, customer service and premium in-store experience provided by StyleColab Preloved.

Reusable shopping bags are available for purchase in-store. Prices are displayed at point of sale and may vary depending on size, style and availability.

Layby transactions incur a $5 layby service fee.

All applicable service fees will be communicated at point of sale.

4. Products and Services

StyleColab Preloved sells pre-loved, consigned and curated fashion items. As many items are pre-owned, condition, sizing, availability and signs of wear may vary between products.

We make reasonable efforts to describe and display products accurately, including colour, condition, size and key details. However, we cannot guarantee that your device display will accurately show product colours or textures.

All products are subject to availability. We reserve the right to limit quantities, refuse sales, discontinue products or remove items from sale at any time.

Some products may be available exclusively in-store or online and may be available in limited quantities.

5. Pricing and Service Changes

Prices for products and services are subject to change without notice.

We reserve the right to modify or discontinue any product, service, promotion, fee or offering at any time.

This includes product pricing, rack rental pricing, in-store service fees, layby fees, reusable bag pricing and promotional offers.

We are not liable to you or any third party for any modification, price change, suspension or discontinuance of a product or service.

6. Billing and Account Information

We reserve the right to refuse or cancel any order at our discretion, including where an item is unavailable, incorrectly priced, incorrectly described, or where we suspect fraud, misuse or unauthorised activity.

You agree to provide current, complete and accurate purchase and account information for all transactions.

You agree to promptly update your contact and payment information so that we can complete transactions and contact you if needed.

7. Returns, Refunds and Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

Due to the pre-loved and consignment nature of many items, all purchases are final unless a remedy is required under Australian Consumer Law.

We do not offer refunds, returns or exchanges for change of mind, incorrect sizing, buyer’s remorse, or where an item was clearly described and inspected before purchase.

Where an item has a major fault that was not disclosed, you may be entitled to a refund, replacement or other remedy in accordance with Australian Consumer Law.

Minor signs of wear, natural ageing, small imperfections or characteristics consistent with pre-loved goods will not automatically constitute a fault where they were visible, disclosed or reasonably expected.

8. Layby Terms

Layby is available on selected in-store items only.

A minimum 30% non-refundable deposit is required to commence a layby.

The remaining balance must be paid within 4 weeks unless otherwise agreed in writing.

A $5 layby service fee applies.

Items placed on layby will only be released once full payment has been received.

All layby purchases are final sale and are not eligible for refunds, returns or exchanges, except where required under Australian Consumer Law.

If payments are not completed within the agreed layby period, we may cancel the layby and all payments made may be forfeited, where permitted by law.

Layby items cannot be transferred, exchanged or substituted once placed on layby unless approved by StyleColab Preloved. Please refer to the layby policy for more information.

9. Consignment and Rent a Rack Services

StyleColab Preloved offers Rent a Rack and consignment services, including:

1. You Style, which is our self-service rack option.
2. We Style, which is our all-inclusive styling and rack management option.

By using our consignment, rack rental or styling services, you agree to comply with the relevant service terms provided to you.

We do not guarantee sales, earnings, sell-through rates or specific outcomes. Sales performance depends on factors including customer demand, pricing, item condition, brand, seasonality, presentation, size, fit and overall market interest.

Consignors may share a rack. However, only one account will be used for the rack and payments will be made to one nominated account.

All items submitted must be clean, in good condition and suitable for resale. We reserve the right to reject items that we consider unsuitable.

We reserve the right to clean, steam, prepare or maintain items where required, and any associated costs may be deducted from sale proceeds.

We are not liable for loss, theft or damage of goods while they are in-store, on display, in storage, being handled, or otherwise in our possession, to the maximum extent permitted by law.

Rack rental fees are non-refundable.

Early collection requires at least 72 hours’ notice. A $5 per item fee may apply for early collection within the first two weeks of the rental period.

Items must be collected at the end of the agreed rental or consignment period. A $25 per day storage fee applies to uncollected items.

Items not collected within 7 days of the end of the rental or consignment period may become the property of StyleColab Preloved and may be donated, sold, disposed of or otherwise handled at our discretion.

10. You Style: Self-Service Rack

Under the You Style option, you are responsible for itemising and pricing your items.

We recommend pricing items at approximately 25% to 33% of their original retail value, depending on condition, brand, demand and seasonality.

You may list up to 40 clothing items and 5 accessories, including a maximum of 3 pairs of shoes, unless otherwise agreed.

You will receive 70% of sale proceeds, less GST and a $1 administration fee per item.

The standard rack pricing phases are:

Week 1 to Week 2: Full price
Week 3: 25% off
Week 4: 50% off

A discretionary 10% discount may be applied in certain circumstances, including promotional periods, customer service situations or where we consider it commercially appropriate.

You are responsible for ensuring your item list and prices are accurate. We are not responsible for pricing errors caused by incorrect information provided by you.

Items must be collected at the end of the rental period. Storage and uncollected item terms apply as set out in these Terms.

11. We Style: All-Inclusive Rack

Under the We Style option, StyleColab Preloved manages pricing, merchandising, display and presentation of your items.

You may provide 40 to 60 items, unless otherwise agreed.

You will receive 50% of sale proceeds, less GST and a $1 administration fee per item.

The standard pricing phases are the same as the You Style option:

Week 1 to Week 2: Full price
Week 3: 25% off
Week 4: 50% off

We will use our judgement when pricing, styling and displaying items. By choosing the We Style option, you acknowledge that pricing and merchandising decisions are made at our discretion.

Unsold items may be collected or donated at the end of the rental or consignment period.

Items not collected within 7 days may become the property of StyleColab Preloved and may be donated, sold, disposed of or otherwise handled at our discretion.

12. Accuracy of Information

We are not responsible if information made available on this website is inaccurate, incomplete or not current.

The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions.

We may modify the contents of this site at any time, but we are under no obligation to update information unless required by law.

13. Third-Party Tools and Links

We may provide access to third-party tools, platforms, applications or links.

We do not monitor, control or endorse third-party tools or websites and are not responsible for their content, accuracy, policies, security or practices.

Your use of third-party tools or websites is entirely at your own risk.

You should review the terms and policies of any third-party provider before engaging with them.

14. User Comments, Feedback and Submissions

If you send us comments, reviews, feedback, submissions, suggestions, images or other content, you agree that we may use, edit, copy, publish, distribute and display that content without restriction, unless otherwise agreed in writing.

You agree that your submissions will not violate any third-party rights, including copyright, trade mark, privacy, personality or other personal or proprietary rights.

You must not submit content that is unlawful, abusive, defamatory, obscene, misleading, harmful or otherwise objectionable.

We may remove content at our discretion.

15. Personal Information

Your submission of personal information through our website, in-store systems or services is governed by our Privacy Policy.

By using our website or services, you acknowledge that your personal information may be collected, used and disclosed in accordance with our Privacy Policy.

16. Errors, Inaccuracies and Omissions

Occasionally there may be information on our website or in our services that contains typographical errors, inaccuracies or omissions.

These may relate to product descriptions, pricing, promotions, offers, availability, service descriptions or other content.

We reserve the right to correct errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time and without prior notice, including after an order has been submitted.

17. Prohibited Uses

You must not use our website, products or services:

1. For any unlawful purpose.
2. To solicit others to perform or participate in unlawful acts.
3. To violate any laws, regulations or rules.
4. To infringe upon our intellectual property rights or the rights of others.
5. To harass, abuse, insult, harm, defame, intimidate or discriminate.

7. To upload or transmit viruses, malware or malicious code.
8. To collect or track the personal information of others.
9. To spam, phish, pharm, pretext, crawl or scrape.

To the maximum extent permitted by law, StyleColab Preloved and its owners, employees, contractors, suppliers and service providers will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages arising from your use of our website, products or services.

This limitation does not exclude any rights or remedies that cannot be excluded under Australian Consumer Law.

19. Indemnification

You agree to indemnify and hold harmless StyleColab Preloved and its owners, employees, contractors, suppliers and service providers from any claim or demand arising out of your breach of these Terms, your misuse of our website or services, or your violation of any law or third-party rights.

20. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by law.

The unenforceable portion will be deemed severed from these Terms and will not affect the validity and enforceability of the remaining provisions.

21. Termination

These Terms remain effective unless and until terminated by either you or us.

You may terminate these Terms at any time by ceasing to use our website and services.

We may terminate your access to our website or services at any time if we believe you have breached these Terms.

The obligations and liabilities incurred before termination will survive termination.

22. Governing Law

These Terms are governed by the laws of Australia.

Where applicable, you agree to submit to the jurisdiction of the courts of the relevant Australian state or territory.
